However, Minnesota Multi Housing Association reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Minnesota Multi Housing Association reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Minnesota Multi Housing Association reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Minnesota Multi Housing Association's sole discretion.

TERMINATION/ACCESS RESTRICTION

Minnesota Multi Housing Association reserves the right, in its sole discretion, to terminate your access to the Minnesota Multi Housing Association Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in San Mateo County, California, U.S.A. in all disputes arising out of or relating to the use of the Minnesota Multi Housing Association Web Site. Use of the Minnesota Multi Housing Association Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. How to Provide Notice of Infringement

If you believe that any portion of the material contained on this site infringes your intellectual property rights, please provide the following information in writing to the MHA Designated Copyright Agent listed above:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. The exact location of and link to the alleged infringing material;
  4. The complaining party’s address, telephone number and electronic email address;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

 

Upon Receipt of Written Notice of Infringement

Once the MHA Designated Copyright Agent has received the written Notice of Infringement containing the information outlined above, MHA will:

  1. Remove or disable access to the alleged infringing material;
  2. Forward the written notification to such alleged infringer; and
  3. Take reasonable steps to promptly notify the alleged infringer that MHA has removed or disabled access to the allege infringing material.

 

Counter-Notice

If you have been accused of copyright infringement and your content has been removed from the MHA website, you may submit a counter notification in writing to the MHA Designated Copyright Agent disputing the allegations in the Notice of Infringement. The Counter-Notice must include:

  1. A physical or electronic signature of the alleged infringer or a person authorized to act on behalf of the alleged infringer;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. The alleged infringer’s name, address, and telephone number; and
  5. A statement that the alleged infringer consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the alleged infringer’s address is outside of the United States, for the judicial district in which MHA may be found, and that the alleged infringer will accept service of process from the person who provided Notice of Infringement, or an agent of such person.

 

Upon Receipt of Counter-Notice

Once the MHA Designated Copyright Agent has received the written Counter-Notice containing the information outlined above, MHA will:

  1. Promptly provide the complaining party with a copy of the Counter-Notice;
  2. Inform the complaining party that MHA will replace the removed material or cease disabling access to it within ten (10) business days; and
  3. Replace the removed material or cease disabling access to the material within ten (10) to fourteen (14) business days following receipt of the Counter-Notice, unless the MHA Designated Copyright Agent receives notice from the complaining party that such person has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity that was the subject of the Notice of Infringement.
